My boyfriend have Duldung,the auslandbehörder took his passport last month,I’m also foreigner but holding a legal residence permit,and I’m 8 mos pregnant I’m working but currently in „Mutterschutz“.my boyfriend is currently employed in one company as full time employee,paying his apartment and not depending on the government for any financial assistance.we already applied for sorgerecht and vaterschaft Anerkennung,my question are 1.is my boyfriend can be deported? 2.can he apply for chancenaufenthalt? 3.what are the documents needed for the application of chancenaufenthalt?hope to hear from you soon.Thank you

Hello @freedom85 thanks for your patience. To deport someone that person will have to have received a so called "Abschiebungsandrohung" which can be included in the rejection of the BAMF.

In cases of deportation, it’s important to try and seek out a specialized advice centre that can look at your boyfriends case. We can unfortunately not offer legal advice on the platform. However, I can help you seek advice. You mentioned that your boyfriend is in Nordreihn-Westfahlen. There are some free legal advice options for example in Dortmund, the Refugee Law Clinic offers advice. Your boyfriend can apply for the Chancenaufenhalt before he applies, it would be good to see if he fulfills the requirements.
To receive the Chancenaufenthalt you must have been living in Germany latest since 31st Oct 2017. Your boyfriend will need to proof that he has been in Germany in the past 5 years and has had a Duldung, Aufenthaltsgestattung or Aufenthalterlaubnis in this period.

In case he is not eligible for the Chancenaufenthalt then it is important to see what other options for a residency he might have. For example, though his child. This is best discussed with a migration counselling centre, who can guide you and look at all the options.

Yara _Community Manager If I were to evaluate,yes he is eligible because since 2016 he is already in Germany,he‘s been waiting for so long.He can speak good deutsch too.

My partner is german national and my senghen visa expired already 2021 . Unforfunately i dont have trc this year july got cancel application for trc because of lawyer mistake and agency .

Thanks for your information bernadetteg789. Often times if you are not in Germany with a valid visa you will be asked to repeat the visa process in your home country. But there are exceptions to this case, a counselling center can help you take the next steps. Have you already been to a migration counseling center? If not I would like to refer your to one.
